1. Acceptance of Terms

By accessing and using PestRetain AI (“the Service”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

PestRetain AI provides an automated customer retention platform for pest control and service businesses. Our platform enables you to import customers, send automated emails, receive missed call alerts, track engagement, and identify upsell opportunities.

3. Account Responsibilities

You are responsible for providing accurate information during account registration, maintaining password confidentiality, and ensuring all activity under your account complies with these terms.

4. Acceptable Use Policy

You agree not to use the Service for spam, illegal activity, harassment, or any use that violates CAN-SPAM, GDPR, or other regulations. You are responsible for ensuring customer consent for all communications.

5. Billing and Payments

Starter ($149/mo), Growth ($299/mo), and Enterprise ($499/mo) plans renew monthly via Stripe. You may cancel anytime and will have 30 days to export data after cancellation.

6. Data Ownership

You retain all ownership of your customer data. We act as a data processor and will not use your data for any purpose other than providing the Service.

7. Limitation of Liability

THE SERVICE IS PROVIDED “AS-IS”. WE DISCLAIM ALL WARRANTIES AND ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE PAST 12 MONTHS.

8. Termination

You may cancel your account anytime. We may terminate accounts that violate these terms, send spam, or engage in illegal activity. Upon termination, you have 30 days to export your data.
